Adele files for divorce

Texas residents who follow celebrity gossip may be aware that Adele and her husband have separated. The 15-time Grammy Award winner filed divorce papers in a Los Angeles court on Sept. 12 citing irreconcilable differences as her reason. Adele is believed to have married her long-time boyfriend in May 2018. The couple are parents to a 6-year-old boy.

Adele frequently posts on social media but rarely shares details about her personal life. She married in a private ceremony and has asked the media to respect her privacy as she and her husband work out the details of their divorce. Press reports indicate that the couple plan to resolve their differences through mediation and enter into a co-parenting arrangement.

Legal observers believe that Adele is wise to consider mediation. The 31-year-old singer is one of the most successful figures in the entertainment business and is said to have personally netted about $55 million from touring engagements in 2016 and 2017. She also earns substantial royalties from albums that have broken sales records in several countries. As California is a community property state, her estranged husband would generally be entitled to half of the marital estate unless they can agree otherwise.

Experienced family law attorneys in states with community property laws may advise their wealthy clients to consider prenuptial or post-nuptial agreements. However, they could explain to them that these documents could be difficult to enforce if their provisions are not essentially fair, they were negotiated in bad faith or one of the parties signed under duress. Prenuptial or pos-tnuptial agreements may specify how marital property will be divided, list separate property that is not subject to division and provide details about spousal support. These agreements cannot contain provisions dealing with child custody or child support.
