Traveling with the kids after divorce

Every Texas divorce case and custody situation is unique. However, all courts decide custody matters with the best interests of the children in mind. For divorced parents who would like to travel internationally with their children, it's important to respect custody arrangements. Generally speaking, it's better to communicate with the other parent before and during the trip.

In cases where one parent has been granted both legal and physical custody, there may be no requirement to report any travel plans to the other parent. Such situations are not the norm, however, and parents are often better off considering major child-related questions together. Shared parenting arrangements can have any number of structures. For example, the plan might allow for specific time periods around Christmas during which each parent has the right to travel out of the country with the kid.

It's important to remember that international travel requires more documentation and preparation than domestic travel. Parents will have to present both their own and their children's passports at the airport. It's also a good idea to create a list of the people on the trip, outline the route and list contact information for hotels and other important points. The other parent should have access to this sort of information.

For parents who are planning to travel but have questions about the legal requirements, it may be wise to consult with an attorney. A lawyer who has experience in family law might be able to go over the relevant custody documents and advise the client regarding his or her rights. If the client believes that child custody arrangement to be unfair, the lawyer could seek a modification.
